The Convenor welcomed all present and ran through the domestics covering fire alarm procedures, etc. 2. Apologies were received from the above Members. AGENDA ITEM 3: MINUTES & MATTERS ARISING FROM THE PREVIOUS MEETING 3. The minutes of the previous meeting, 16 October 2009, held at Albert Memorial Hall, Ballater were approved subject to amendment as follows. Page 5 below Item 36, declaration of interest should be placed immediately prior to Item 31. Page 9, Agenda Item 11, amend the word FEE in the title to FEED, and Item 67(c) the word portal changed to porta-loo. 4. There were no matters arising. AGENDA ITEM 4: DECLARATION OF INTEREST BY MEMBERS ON ANY ITEMS APPEARING ON THE AGENDA 5. Stuart Black declared an indirect interest in Planning Application No. 09/329/CP, family member employment AGENDA ITEM 5: PLANNING APPLICATION CALL-IN DECISIONS (Oral Presentation, Derek Manson) 6. 09/327/CP - No Call-in 7. 09/328/CP - The decision was to call-in the application for the following reason : • The application seeks to vary a condition relating to the window type that the CNPA applied to an earlier consent. The proposal raises issues in relation to the interests of visual amenity and as the CNPA determined the earlier consent the application is considered to be of linked general significance to the collective aims of the National Park. 8. 09/329/CP - No Call-in 9. 09/330/CP - No Call-in 10. 09/331/CP - No Call-in 11. 09/332/CP - No Call-in 12. 09/333/CP - No Call-in 13. 09/334/CP - No Call-in 14. 09/335/CP - No Call-in 15. 09/336/CP - No Call-in 16. 09/337/CP - No Call-in 17. 09/338/CP - The decision was to call-in the application for the following reason : • The application is for planning permission in principle for mixed affordable housing and retail development, access and parking and the demolition of an existing house. The proposed development is on a site within the commercial core of Aviemore with a number of trees proposed to be felled. The application raises issues in relation to affordable housing, impact on trees and built heritage and the general economic and social redevelopment of the centre of Aviemore. As such, the proposal is considered to raise issues of general significance to the collective aims of the National Park 18. 09/339/CP - The decision was to call-in the application for the following reason : • The proposal is for the erection of a caretakers house in a Restricted Countryside Policy Area where there are general restrictions on residential development unless there is a demonstrable justification. The site is also on the boundary of a Public Right of Way and lies within a National Scenic Area. The development therefore raises issues in relation to housing in the countryside policy, cumulative impact of housing in the countryside, precedent, visual and landscape impacts and design and impacts on formal recreational access. As such, the proposal is considered to raise issues of general significance to the collective aims of the National Park. 19. 09/340/CP - No Call-in COMMENTING ON APPLICATIONS NOT CALLED-IN BY THE COMMITTEE 20. The Members wished to make comments to the Local Authorities on the following Planning Application No’s 09/327/CP, 09/333/CP. The planning officers noted these comments and were delegated with the responsibility of whether or not to submit the comments to the Local Authorities. AGENDA ITEM 6: ANY OTHER BUSINESS 21. At the request of the Convenor, Bill Stewart informed Committee that the appeal decision had been received that morning on Planning Application 08/184/CP, Land 150m South of St Vincents Hospital, Gynack Road, Kingussie which was refused by CNPA on 28 November 2008. The Scottish Government decision was to grant planning permission subject to 5 conditions but to decline a claim for expenses by the applicant as it was deemed the CNPA had not acted in an unreasonable manner. Bill Stewart summarised the conditions and agreed to send a copy of the conditions to the Members by email. 22. The Convenor commented that although it was not the outcome CNPA hoped for, a lot of positives could be taken from it as the conditions made by the Reporter had covered a lot of the Members’ concerns. AGENDA ITEM 7: DATE OF NEXT MEETING 23. Friday, 13th November 2009 at 10.30am 24. Committee Members are requested to ensure that any Apologies for this meeting are submitted to the Planning Office in Ballater. 25. The meeting concluded at 10:55hrs. END
